Terms & Conditions

These terms are the agreement between you and TabulaKit when you create an account and use our services. By signing up, you accept them. Please read them carefully.

1. About these terms

TabulaKit (“TabulaKit”, “we”, “us”, or “our”) provides an AI-assisted website building service. These Terms & Conditions, together with our Privacy Policy, govern your access to and use of that service. If you are using TabulaKit on behalf of an organization, you confirm that you have authority to accept these terms for that organization.

2. The service

TabulaKit gives you a private cloud workspace in which an AI assistant helps you build and publish content and documentation websites through plain-language conversation. Features, limits, and included allowances depend on your plan. We may add, change, or remove features over time as the service evolves.

3. Your account

You need an account to use TabulaKit. You are responsible for keeping your login details safe, for all activity that happens under your account, and for anyone you invite or grant access to. Tell us promptly if you believe someone has gained access without your permission. You must be old enough to enter into a binding contract in your location to hold an account.

4. Plans, billing, and trials

Paid plans are billed in advance on a recurring monthly basis through our payment processor, Stripe. By starting a paid plan you authorize us to charge your chosen payment method for the plan fee until you cancel.

  • Free trial. If your plan begins with a free trial, it converts to the applicable paid plan at the end of the trial period unless you cancel before it ends.
  • Ink allowance. AI usage on TabulaKit is measured in units of ink, counted in drams. Each plan includes a monthly allowance of ink, and higher-tier plans are granted more ink each month. If you need more than your plan includes, you can purchase additional ink at any time, on top of your monthly allowance. If you use up your ink and have not purchased more, we may pause AI activity until your next monthly cycle or ask you to move to a higher plan.
  • Cancellation. You can cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then.
  • Refunds. Except where required by law, fees already paid are non-refundable.
  • Price changes. We may change plan pricing, and will give you reasonable notice before a change affects your renewals.

5. Acceptable use

You agree not to use TabulaKit to:

  • break any law, or infringe anyone’s intellectual property, privacy, or other rights;
  • publish or store content that is unlawful, harmful, deceptive, or that you do not have the right to use;
  • attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the service or its underlying systems;
  • resell or provide the service to others in a way not permitted by your plan; or
  • use the service to build or distribute malware, spam, or material that exploits or endangers others.

We may suspend or remove content, or suspend an account, that we reasonably believe breaks these rules.

6. Your content

You keep ownership of the content you create, upload, or publish through TabulaKit. You grant us the limited permission needed to host, process, and display that content so we can provide the service to you — including passing it to the AI and infrastructure providers described in our Privacy Policy. You are responsible for your content and for making sure it does not break these terms or the law.

7. AI-assisted output

TabulaKit uses AI to help generate text, layouts, and other material based on what you ask for. AI output can be inaccurate or unsuitable, so you are responsible for reviewing anything the assistant produces before you rely on it or publish it. We do not warrant that AI-generated output is accurate, original, or fit for any particular purpose.

8. Publishing

When you publish a site, you are making that content available on the internet at an address associated with your account. You are responsible for what you publish, including making sure you have the rights to any text, images, and other material, and that it complies with applicable laws. You control whether a published site is open to everyone or limited to specific people.

9. Our intellectual property

The TabulaKit service, software, and branding are owned by us or our licensors and are protected by intellectual property laws. These terms do not give you any rights in them beyond the right to use the service as intended.

10. Availability

We work to keep TabulaKit available and dependable, but we do not guarantee uninterrupted or error-free service. Workspaces sleep when idle to keep costs down and wake again when you return; sites you have already published stay online independently of your workspace. We may perform maintenance, and we may modify or discontinue parts of the service.

11. Suspension and termination

You may stop using the service and close your account at any time. We may suspend or end your access if you breach these terms, if required by law, or to protect the service or other users. When an account ends, your right to use the service stops, and we may delete associated data after a reasonable period.

12. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the fullest extent permitted by law, TabulaKit will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the twelve months before the claim.

14. Changes to these terms

We may update these terms from time to time. When we make material changes, we will take reasonable steps to let you know. Continuing to use the service after changes take effect means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the jurisdiction in which TabulaKit operates, without regard to conflict-of-law rules.
